data exclusivity [ENGLISH]

The period of eight years from the initial authorisation of a medicine during which the marketing-authorisation holder benefits from the exclusive rights to the results of preclinical tests and clinical trials on the medicine. After this period, the marketing authorisation holder is obliged to release this information to companies wishing to develop generic versions of the medicine.

Den period på åtta år från det första godkännandet av ett läkemedel under vilken innehavaren av godkännandet för försäljning åtnjuter ensamrätten till resultaten av prekliniska tester och kliniska prövningar av läkemedlet. Efter denna period är innehavaren av försäljningstillståndet skyldig att lämna ut denna information till företag som vill utveckla generiska versioner av läkemedlet.
